Introduction

Welcome to NationOver! Gigperfect LLC is doing business as NationOver. This document outlines the legal rights and obligations between Gigperfect LLC, and any of it's successor companies, and you, the user. These Terms of Service ("Terms") govern your access to and use of the NationOver platform, including any content, functionality, and services offered on or through our website (the "Service"). These Terms of Service are subject to our Privacy Policy. In case of any conflict between these Terms and our Privacy Policy, our Privacy Policy will govern and take precedence. Our commitments regarding data retention, deletion, and user rights as outlined in our Privacy Policy supersede any conflicting language in these Terms.

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Definitions

  • "Service" refers to the NationOver platform.
  • "User" refers to any individual who accesses or uses the Service.
  • "Job Seeker" refers to a User who submits job applications through the Service.
  • "Employer" refers to a User who accesses job applications through the Service.
  • "Content" refers to all information, data, text, software, music, sound, photographs, graphics, videos, messages, or other materials submitted to or available through the Service.

Account Registration

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

User Conduct

You agree not to:

  • Use the Service in any way that violates any applicable law or regulation.
  • Use the Service for the purpose of exploiting, harming, or attempting to exploit or harm minors.
  • Transmit any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
  • Impersonate or attempt to impersonate NationOver, an employee, another user, or any other person or entity.
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
  • Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

Content Moderation and Account Management

To maintain a safe, professional, and productive environment for all users, NationOver reserves the right to moderate, review, and take action regarding user accounts, content, and activities at our sole discretion.

Our Moderation Rights:

We may, without prior notice and at our sole discretion:

  • Review, monitor, edit, or remove any Content submitted to the Service
  • Suspend, restrict, or terminate user accounts
  • Limit access to specific features or sections of the Service
  • Remove job postings, applications, or profiles
  • Issue warnings or temporary restrictions
  • Ban users from the platform permanently

Grounds for Moderation:

We may take moderation action to:

  • Protect the safety and security of our users and community
  • Maintain professional standards appropriate for a job board platform
  • Prevent fraud, spam, or misuse of the Service
  • Enforce these Terms of Service and our community guidelines
  • Comply with legal requirements or court orders
  • Address user complaints or reports of inappropriate behavior
  • Maintain the integrity and reputation of the NationOver platform

Community Standards:

We are committed to fostering a professional environment where job seekers and employers can connect effectively. Content or behavior that undermines this mission, creates a hostile environment, or violates professional standards may be subject to moderation action, even if not explicitly prohibited elsewhere in these Terms.

No Obligation to Monitor:

While we reserve the right to moderate content and accounts, we are under no obligation to monitor, review, or moderate any Content or user activity. Users are responsible for their own Content and interactions on the platform.

Appeals Process:

If you believe moderation action was taken in error, you may contact us through our Contact Page to request a review. We will consider appeals in good faith, but our final decision regarding moderation actions is binding.

Repeat Violations:

Users who repeatedly violate these Terms or engage in behavior requiring moderation action may face escalating consequences, including permanent account termination, regardless of the individual severity of each violation.

We strive to apply our moderation policies fairly and consistently, but recognize that each situation is unique. Our goal is always to maintain NationOver as a trusted platform where job seekers and employers can connect in a professional, safe environment.

Job Seeker Terms

As a Job Seeker, you agree to:

  • Provide accurate and truthful information in your job applications.
  • Only submit applications for positions you have genuinely applied to.
  • Not submit any Content that infringes on the intellectual property rights of others.
  • Not submit any Content that contains confidential information from current or former employers.
  • Maintain the confidentiality of communications with Employers.

You understand and acknowledge that:

  • Your application information will be shared with Employers based on your privacy settings.
  • We do not guarantee that you will receive job offers or interviews through the Service.
  • We are not responsible for the actions of Employers who view your application.

Employer Terms

As an Employer, you agree to:

  • Provide accurate information about your company and job opportunities.
  • Use Job Seekers' information solely for employment consideration purposes.
  • Respect Job Seekers' privacy settings and permission requirements.
  • Not discriminate against Job Seekers based on race, color, religion, sex, national origin, age, disability, or any other status protected by law.
  • Comply with all applicable employment and data protection laws.

You understand and acknowledge that:

  • Access to applications requires a paid subscription.
  • Subscription fees are non-refundable except as required by law.
  • We do not guarantee the accuracy or completeness of Job Seekers' information.
  • We are not responsible for hiring decisions or employment relationships that result from the use of our Service.

Subscription and Payment Terms

Employers must purchase a subscription to access applications on the Service. By purchasing a subscription, you agree to:

  • Pay all fees associated with your subscription plan.
  • Provide accurate and complete billing information.
  • Authorize us to charge your payment method for the subscription fees.

Subscription terms:

  • Monthly subscriptions will automatically renew each month until canceled.
  • Annual subscriptions will automatically renew each year until canceled.
  • You may cancel your subscription at any time through your account settings or by contacting us.
  • No refunds will be provided for partial subscription periods or unused portions of your subscription.

Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by NationOver, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

User Content License

You retain ownership of any Content you submit to the Service. By submitting Content to the Service, you grant NationOver a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such Content solely in connection with providing, operating, promoting, and improving the Service.

Duration and Termination of License:

This license will continue for as long as:

  • Your account remains active, OR
  • We have a legitimate business need to retain your Content as outlined in our Privacy Policy, OR
  • We are required by law to retain your Content

License Termination:

This license will automatically terminate when:

  • You delete your account and request data deletion
  • We no longer have a legitimate business need for your Content
  • The retention period specified in our Privacy Policy expires
  • You exercise your data deletion rights under applicable privacy laws

Effect of License Termination:

Upon termination of this license, we will delete your Content from our active systems within 30 days, except for:

  • Content stored in backup systems, which will be deleted according to our standard backup retention schedule
  • Content we are legally required to retain
  • Content that has been anonymized and aggregated in a way that cannot identify you

Consistency with Privacy Policy:

This license is subject to and limited by the commitments made in our Privacy Policy. In case of any conflict between this license and our Privacy Policy, the Privacy Policy will prevail.

Business Transfers and Successors

In the event of a business combination, merger, acquisition, or asset sale, any successor company will be bound by the same privacy commitments outlined in our Privacy Policy. User content licenses will only transfer to the extent consistent with our Privacy Policy commitments, and users will retain all rights to request data deletion from the successor company.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NATIONOVER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT WILL NATIONOVER, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless NationOver, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you request account deletion, we will delete your personal information and Content in accordance with our Privacy Policy commitments, including the timelines and exceptions specified therein. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Service thereafter.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
